1. Acceptance of Terms

By accessing and using NitroCloud services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

NitroCloud provides a cloud-based platform for deploying, managing, and scaling MCP (Model Context Protocol) applications. Our services include but are not limited to hosting, deployment automation, monitoring, and related infrastructure services.

3. User Accounts and Registration

To access certain features of the service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate, current, and complete
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use the service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any malicious code, viruses, or harmful content
• Interfere with or disrupt the integrity or performance of the service
• Attempt to gain unauthorized access to the service or related systems
• Use the service for any illegal or unauthorized purpose
• Impersonate any person or entity or misrepresent your affiliation

5. Payment and Billing

If you purchase any paid services:

• You agree to pay all fees associated with your use of the service
• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days notice
• Failure to pay may result in suspension or termination of your account

6. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted or error-free operation. We reserve the right to perform scheduled maintenance, which may result in temporary service interruptions. We are not liable for any damages resulting from service unavailability.

7. Intellectual Property

The service and its original content, features, and functionality are owned by NitroStack and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you upload or create using the service.

8. Data and Privacy

Your use of the service is also governed by our Privacy Policy. By using the service, you consent to the collection and use of information in accordance with our Privacy Policy.

9. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including:

• Breach of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended periods of account inactivity

Upon termination, your right to use the service will immediately cease. We may delete your account and data after a reasonable retention period.

10. Limitation of Liability

To the maximum extent permitted by law, NitroStack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

11. Indemnification

You agree to defend, indemnify, and hold harmless NitroStack and its officers, directors, employees, and agents from and against any claims, actions, suits, or proceedings, as well as any losses, liabilities, damages, costs, and expenses arising out of or relating to your use of the service, violation of these terms, or infringement of any rights of another.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through a notice on our website. Your continued use of the service after such modifications constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
